Off Broadway Shoes 2015 The Kentucky Oaks and The Kentucky Derby Official Sweepstakes Rules
Entry: Sweepstakes starts on April 1, 2015 at 12:00:01 AM ET and ends on April 19, 2015 at 11:59:59 PM ET (the “Promotion Period”). During the Promotion Period, enter by visiting the Off Broadway Shoes retail location at 4600 Shelbyville Road. Suite # 201, Louisville, KY 40207 and submitting a completed official entry form. Limit 1 entry per person, regardless of method of entry. No automatic, programmed, robotic or similar means of entry are permitted. Incomplete entries will be disqualified at the Sponsor’s sole discretion. Upon submission, all entries become the property of Sponsor and will not be returned. Eligibility: Sweepstakes is open only to legal residents of AL, AZ, CA, CO, CT, DE, FL, GA, IL, IN, KS, KY, MA, MD, ME, MO, MS, NC, NV, NH, NJ, OH, SC, TN, TX and Washington, D.C. who, as of the date of entry, are 18 years of age or older. Employees, shareholders, officers and agents of Off Broadway Shoes (‘Sponsor”), Rack Room Shoes, Operator, their respective affiliates or advertising/promotion agencies, and their immediate family members and persons residing in the same household of such employees are not eligible to enter or win this Sweepstakes.
Prizes/Drawings: Sponsor will award 1 Grand Prize. The Grand Prize winner will receive a pair of club level box seat tickets to The Kentucky Derby (approximate retail value is $1,500 total $750 per ticket). Sponsor will randomly select the Grand Prize winner from all eligible entries submitted during the Promotion Period. Drawings will occur on or after April 20, 2015. Odds of winning tickets depend on the number of eligible entries received.
Sponsor will not replace any lost, mutilated, or stolen tickets. Terms and conditions of all tickets and of the applicable venue apply. All expenses including travel, transportation, meals and lodging costs, of any kind, or other expenses are solely the responsibility of winner and winner’s guest. Winners are responsible for all federal, state, and local taxes. Sponsor is not responsible if The Kentucky Oaks or The Kentucky Derby, or any component event, is delayed, postponed or cancelled for any reason, in which event that portion of prize is forfeited in its entirety and no substitution will be provided except in Sponsor’s sole discretion. Winner will be notified by mail or telephone and will be required to sign an Affidavit of Eligibility. If any prize notification is returned as undeliverable, or if winner does not respond to notification by email or phone within three (3) business days of the date of notification, prize will be forfeited and an alternate winner will be selected. Each potential winner will be required to sign and return, within five (5) days of the date affidavit is mailed, an Affidavit of Eligibility, Liability & Publicity Release (an “Affidavit”) in order to claim his/her prize. If a potential winner fails to sign and return the Affidavit within the five-day period, potential winner forfeits prize. Guest of winner will also be required to sign a Guest Release in order to attend the event.
Miscellaneous: Sponsor is not responsible for incomplete, damaged, delayed, destroyed, garbled, incomplete, misdirected, illegible or lost entries. Sponsor is not responsible for any typographical or other error in the printing or advertising of this Sweepstakes, the administration or execution of this Sweepstakes, or in the announcement of prizewinners. Sponsor is not responsible for any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries, or for unauthorized access to, or alteration of, entries; failed or unavailable hardware, network, software or telephone transmissions, damage to entrants’ or any person’s computer and/or its contents, or causes beyond Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes. If Sponsor determines, in its sole discretion, that this Sweepstakes cannot be executed as planned, for any causes beyond the control of Sponsor that corrupt or affect the security, administration, fairness, integrity or proper conduct of this Sweepstakes (including but not limited to infection by computer virus, tampering, unauthorized intervention, fraud, technical failures) Sponsor reserves the right to terminate this Sweepstakes, to and/or modify this Sweepstakes and/or conduct a random drawing to award the prize(s) using all eligible entries received as of the termination date. By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and by the decisions of Sponsor, whose decisions regarding all aspects of the Sweepstakes shall be final and binding. Winner’s eligibility is contingent on winner’s compliance with all terms and conditions of these Official Rules and upon fulfilling all requirements. In the event that a winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries in the same pool. By acceptance of a prize, each winner releases and agrees to indemnify and hold harmless Sponsor, its affiliates, subsidiaries, advertising and promotion agencies, from any and all liability, for property damage, personal injury, loss, harm, damage, injury, cost or expense whatsoever to winner or winner’s guest including, without limitation, death which may occur in connection with preparation for, or participation in, this Sweepstakes, or possession, acceptance and/or use or misuse of the prize or participation in any Sweepstakes-related activity. Except where prohibited or restricted by law, winner’s acceptance of a prize constitutes winner’s grant of permission for Sponsor and its agents to use winner’s name, city and state of residence, hometown, photograph or other likeness, voice, testimonials, biographical information or statements for advertising, trade and publicity purposes, worldwide, including on the Internet, at any time or times without prior notification, review, or approval or further compensation.
